Privacy Policy
What we hold, and what we never do with it.
How Montclair Diamonds collects, uses, stores and discloses personal information, consistent with the Privacy Act 1988 (Cth) and the Australian Privacy Principles. Current as at September 2026.
Our Practices
01Information you give us
Ordering gives us your name, delivery address, email address, phone number and order contents. Emailing us adds that correspondence, which we retain so we have history if you write again.
02Engraving text
Where you supply engraving text we hold it against the order. It is often a name or a date with personal meaning, it is visible only to the people who make and check the ring, and it is not used for anything else.
03Payment information
We never see or store your full card number. Card data passes directly to our payment provider under their own controls. We receive a result, the card type and the final four digits.
04Identity verification
On higher-value orders we may ask to sight identification or confirm a billing address. Where we do, the document is checked, the result recorded, and the copy deleted. We do not retain images of identity documents.
05Information collected automatically
Our platform and analytics record IP address, device and browser type, referring source and the pages you view. This is used in aggregate to understand how the store performs.
06Cookies
Cookies hold your cart between pages, remember preferences and support analytics. Your browser can block or clear them, though the cart and checkout will not function properly without the essential ones.
07Why we hold it
To fulfil and insure orders, communicate with you about them, administer resizes, returns and warranty claims, detect fraudulent transactions, and meet our record-keeping obligations under Australian law.
08Marketing
Marketing email goes only to people who have opted in, and every one carries a working unsubscribe link that takes effect immediately. Emails about an order you have placed are transactional and continue regardless.
09Surprise orders
Where an order is a gift or a proposal, we will not contact the recipient. Correspondence goes to the person who placed the order, at the address they gave us.
10Who we share it with
Only providers who need it to perform a function: our ecommerce platform, payment provider, the insured carrier delivering your ring, and our email platform if you have subscribed. Each is bound by its own privacy obligations.
11What we never do
We do not sell personal information. We do not rent or trade contact lists. We do not pass your details to unrelated businesses for their marketing.
12Disclosure required by law
We may disclose information where legally compelled, including a court order, a lawful regulatory request, or where necessary to establish or defend a legal claim.
13Storage outside Australia
Some providers store data on servers overseas, including in the United States and the European Union. Where that occurs we take reasonable steps to ensure the recipient handles it consistently with the Australian Privacy Principles.
14How long we keep it
Order and transaction records are retained for seven years to satisfy Australian tax and business record requirements. Marketing subscriptions are held until you unsubscribe. General enquiries are cleared periodically once resolved.
15Security
The site runs over encrypted connections, access to customer records is limited to those who need it, and administrator accounts require two-factor authentication. No system is perfectly secure and we make no claim that ours is.
16Access, correction and deletion
You may ask what personal information we hold and we will provide it. You may ask us to correct anything inaccurate, and to delete anything we are not legally required to keep. Requests go through the Contact Us page and are answered within thirty days.
17Data breaches
Where a breach occurs that is likely to result in serious harm, we will notify the individuals affected and the Office of the Australian Information Commissioner, as the Notifiable Data Breaches scheme requires.
18Age
This store is intended for adults. We do not knowingly collect personal information from anyone under eighteen, and delete it where we become aware that we have.
19Complaints
Contact us first and we will investigate. If our response does not resolve the matter you may escalate to the Office of the Australian Information Commissioner at oaic.gov.au.
